NYS DMNA World Trade Center Benefits Program (WTC-BP)

The DMNA WTC-BP Eligibility Tool was designed to help potential claimants quickly determine whether they may be eligible for benefits under the WTC-BP.

The Tool is to be used for informative purposes only and does not represent a final determination on eligibility or benefits.

Were you activated on state active duty (SAD) on or after September 11, 2001, to participate in World Trade Center rescue, recovery or cleanup efforts?

In order to be eligible, you must have been issued official orders activating you on SAD by the New York Army National Guard, the New York Air National Guard, the New York Naval Militia or the New York Guard.

Did you participate in the World Trade Center rescue, recovery, or cleanup operations within the World Trade Center site * for:

any period within the forty-eight hours after the first airplane hit the towers; or
a total of forty hours accumulated any time between September 11, 2001, and September 12, 2002?

* The World Trade Center site is defined as the area in Manhattan south of the line that runs along Canal Street from the Hudson River to the intersection of Canal Street and East Broadway, north on East Broadway to Clinton Street, and east on Clinton Street to the East River; and any area related to or along the routes of debris removal, such as barges and the Fresh Kills landfill.

Did you participate in the World Trade Center rescue, recovery, or cleanup operations:

any period within the forty-eight hours after the first airplane hit the towers; or
a total of forty hours accumulated any time between September 11, 2001, and September 12, 2002, by repairing, cleaning or rehabilitating vehicles or equipment that was contaminated by debris in the World Trade Center site prior to decontamination of such vehicles or equipment?

Have you been diagnosed with a qualifying World Trade Center condition?

Qualifying conditions for this presumption include:

Upper respiratory tract (rhinitis, sinusitis, pharyngitis, laryngitis, vocal cord disease, upper airway hyper-reactivity and tracheobronchitis, or a combination of such conditions);
Lower respiratory tract (bronchitis, chronic obstructive pulmonary disease, asthma, reactive airway dysfunction syndrome and various forms of pneumonitis — hypersensitivity, granulomatous, or eosinophilic);
Gastroesophageal tract (esophagitis and reflux disease);
Psychological (post-traumatic stress disorder, anxiety, depression, or any combination of these conditions);
Skin (conjunctivitis, contact dermatitis or burns, infectious, irritant, allergic, idiopathic or non-specific in nature, caused by exposure or aggravated by exposure);
New onset diseases (resulting from exposure as such diseases may occur in the future including cancer, asbestos-related diseases, heavy metal poisoning, musculoskeletal disease and chronic psychological diseases).

The WTC-BP is limited to service members from the New York Organized Militia that were activated on state active duty (SAD) on or after September 11, 2001, to participate in World Trade Center rescue, recovery or cleanup efforts within the World Trade Center site.

If you were not a member of the New York Organized Militia, you are not eligible for benefits under the WTC-BP.

However, you may be eligible for benefits under other programs such as the Federal Victims Compensation Fund (https://www.vcf.gov/) or the New York State World Trade Center Presumption law administer by the Office of the State Comptroller (https://www.osc.ny.gov/).

If you were not issued official orders activating you on SAD on or after September 11, 2001, to participate in World Trade Center rescue, recovery or cleanup efforts you are not eligible for benefits under the WTC-BP.

If you did not participate in World Trade Center rescue, recovery or cleanup efforts the World Trade Center site within the requisite timeframe you are not eligible for benefits under the WTC-BP.

Members of the New York Organized Militia that were activated on State Active Duty on or after September 11, 2001, to participate in World Trade Center rescue, recovery or cleanup efforts within the World Trade Center site do not need to be sick or have been diagnosed with a qualifying condition to register with the WTC-BP.

You can register at any time so long as you do so before the Registration Deadline of September 11, 2026. Registering with the WTC-BP preserves your right to file a claim, either now or at some point in the future.

Members of the New York Organized Militia that were activated on State Active Duty on or after September 11, 2001, to participate in World Trade Center rescue, recovery or cleanup efforts within the World Trade Center site that have been diagnosed with a qualifying condition are encouraged to register with the WTC-BP now.
