31 U.S.C. Subtitle V, Chapter 6305

Cooperative Agreement is A legal instrument reflecting a relationship between the US Government and a State, when:

the principal purpose of the relationship is to transfer a thing of value to carry out a public purpose of support or stimulation authorized by law instead of procurement (acquiring property or services for the direct benefit or use of the US Government); and
Substantial Involvement between Executive Agency (NGB) and Recipient (State) is expected in carrying out the activity in the Agreement
